marketing, and website design and development. Services may be subject to additional terms
and conditions.

4. Payment
Payment for Excellorix services is due as specified in the service agreement. Late payments may
result in a suspension or termination of services.

5. Termination
Excellorix reserves the right to terminate your access to the services at any time without notice
for any reason, including but not limited to, breach of these Terms.

6. Disclaimer of Warranties
The services of Excellorix are provided “as is” without any warranties of any kind, either express
or implied, including but not limited to, the implied warranties of merchantability, fitness for a
particular purpose, or non-infringement.

7. Limitation of Liability
Excellorix shall not be liable for any direct, indirect, incidental, special, consequential or
exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data
or other intangible losses, resulting from the use or inability to use the services.

8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in
which Excellorix is based, without regard to its conflict of law provisions.
